Abstract

In his research paper, Mufti Muhammad Shafi discusses two types of issues: Laws Regarding Adultery: According to Mufti Shafi, the penalties for adultery varied in different eras and were subject to differing interpretations due to variations in legal systems. His objective was to confirm that it is essential to present these laws with careful consideration and explanation to avoid any doubts or misunderstandings. He emphasizes that the penalties for adultery can be inferred from the sayings of the Prophet (Hadith) and verses of the Quran, and they encompass various historical contexts. Initially, these penalties were severe, and the judges or rulers had the authority to impose punishments on those involved in adultery and could confine women to their homes, as explicitly mentioned in Surah An-Nisa in the Quran. Issues Related to Homicide and Retaliation (Qisas): His second focus in the research paper is on issues related to homicide and retaliation (Qisas). In this section, he discusses the laws and sources that pertain to the acceptance of Qisas, or retaliation, as a valid form of punishment. In this research paper, Mufti Muhammad Shafi conducts a detailed study of significant Islamic issues, taking into account the various social and intellectual factors present in different eras. This approach allows for an in-depth analysis of penalties and a logical understanding of their context.
